Terms of Service

These Terms of Service (the "Terms") are a contract between you and Patrick Frayer ("Varsity Forever", "we", "us") governing your use of the Varsity Forever website and mobile applications (the "Service").
1. Acceptance and eligibility
By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service. You must be at least 18 years old to use the Service.
If the age of majority where you live is above 18, you must have reached that age to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind it.
2. Your account
You must give accurate registration information and keep it current. You are responsible for your credentials and for all activity under your account, and you must tell us promptly at frayerathletics@gmail.com if you suspect unauthorised access. Accounts are personal to you and may not be shared, sold or transferred.
3. The Service
Varsity Forever provides general strength and conditioning programming generated from the answers you give in the athlete assessment, together with workout logging and progress tracking. A free tier is available. Pro adds adaptive programming and additional analytics. We may add, change, suspend or withdraw features at any time, and we may set reasonable usage limits.
4. Subscriptions, billing and auto-renewal
Pro is offered as an auto-renewing subscription. Our order process for web purchases is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our web orders. Paddle provides all customer service inquiries and handles returns, and web purchases are also subject to Paddle's Buyer Terms. Purchases in the iOS and Android apps are processed by Apple and Google and are also governed by their store terms.
Your subscription renews automatically for successive periods at the then-current rate until cancelled. Founding 100 is billed at $49 for the first year and renews automatically at $79 per year thereafter unless you cancel. Web charges are taken by the payment method on file; App Store purchases are charged to your Apple ID within 24 hours before the end of the current period unless auto-renew is turned off at least 24 hours before that date.
We may change prices. We will give you notice before a price change takes effect, and the new price applies from your next renewal. If you do not accept it, cancel before that renewal. Cancellation stops future renewals; access continues to the end of the paid period. Cancel on the web from your account page, and on mobile from your Apple ID or Google Play subscription settings.
5. Refunds
Refunds and cancellations are governed by our Refund and Cancellation Policy, which forms part of these Terms. Purchases made through Apple or Google are refunded only by those stores under their own policies.
6. Assumption of risk and release
Physical training carries inherent risk of injury, illness, and in rare cases death. By using the Service you confirm that you are medically able to exercise, that you have consulted a qualified professional if you have any condition that training could affect, and that you voluntarily assume all risk of participating.
Varsity Forever is not a medical provider and does not offer medical advice, diagnosis, treatment or rehabilitation. Stop training and seek medical attention if you experience pain, dizziness, shortness of breath or any other warning sign. To the fullest extent permitted by law, you release and hold harmless Patrick Frayer and its officers, employees and contractors from any claim arising out of your participation in training suggested by the Service.
7. No guarantee of results
Training outcomes depend on factors we do not control, including consistency, sleep, nutrition, injury history and genetics. We make no promise of any particular strength, body-composition, performance or health result.
8. Acceptable use
You agree not to:
- use the Service unlawfully or in breach of these Terms;
- copy, resell, sublicense or republish programming or other content;
- reverse engineer, scrape, or attempt to bypass access controls or entitlements;
- upload malware or interfere with the integrity or performance of the Service;
- access another user's account or data;
- misrepresent your identity or affiliation.
9. User content
You keep ownership of the content you submit, including assessment answers, workout logs and notes. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and process that content solely to operate and improve the Service and to provide it back to you. You are responsible for the content you submit and confirm you have the right to submit it.
10. Intellectual property
The Service, including its software, programming logic, exercise libraries, text, design, and the Varsity Forever name and marks, is owned by Patrick Frayer and protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial training. All rights not expressly granted are reserved.
11. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, error-free or that content is accurate or suitable for you.
12. Limitation of liability
To the fullest extent permitted by law, neither Patrick Frayer nor its officers, employees, contractors or suppliers is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data or goodwill. Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Patrick Frayer and its officers, employees and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination your licence ends immediately; sections that by their nature should survive — including risk, disclaimers, liability, indemnity and governing law — continue to apply.
15. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-law rules. The courts located in Alabama have exclusive jurisdiction over any dispute, and you and we consent to that jurisdiction and venue. Nothing here limits any mandatory consumer protection right available to you where you live.
16. Changes to these Terms
We may update these Terms. We will post the revised version with a new effective date and, for material changes, notify you by email or in the app before they take effect. Continuing to use the Service after that date means you accept the updated Terms.
